Sale deed of Congress bhavan challenged in Court
Shankar Munvalli, former Convener of SC-Cell of Karnataka Pradesh Congress Committee has filed a Writ Petition under Article 226 and 227 of the Constitution before the High Court of Karnataka Bench at Dharwad challenged the Sale Deed executed by the Belagavi City Corporation to allot 10 guntas of land in CTS Nos.3926 and 3927 near RTO/Sangolli Rayanna Circle land in favour of ‘Laxmi R. Hebbalkar, President, Belagavi (Rural) District Congress Samiti’ in contrary to the State government orders recently.
Chief minister Siddaramaiah is scheduled to lay foundation stone for construction of the party’s district office on the premises in the question on Tuesday afternoon.
Though the government on July 5 sanctioned the land (for a throw away price of only Rs.54,45,000=00 (@ Rs.500/- sq.ft) to ‘Belagavi District Congress Office’, sale deed executed by the Commissioner of BCC was in favour of “The President Belagavi District (Rural) Congress Samiti, Represented by Smt. Laxmi R. Hebbalkar”.
Citing six grounds in his petition where the State government was Respondent No.1, Deputy Commissioner and BCC represented by its Commissioner as Respondents No.2 and 3 respectively and Ms.Hebbalkar the 4th Respondent, Mr.Munavalli argued that Ms.Hebbalkar was not at all entitled to secure a sale deed of the premises in her individual capacity in contrary to the ‘sanction order’ of State government. Ms.Hebbalkar, pursuant to the sale deed got her name mutated in the concerned records but the first three respondents failed to take immediate action into the matter. The matter was brought to the notice of the deputy commissioner in vain.
